Estate Planning
We will review your current Will to verify that it is suitable for your current
circumstances and that your Will accurately reflects you wishes. We will assist you to minimise the risk of family disputes and to avoid the likelihood of your family
suffering financially
We will provide advice and strategies to maximise the use and enjoyment of your
assets while you are alive, as well as minimising the tax impact upon transfer of your assets to beneficiaries.
Often the accumulation of wealth does not occur within the actual estates of
individuals but exists within corporate entities, trusts, superannuation funds and the like. We will assist to ensure that your estate planning intentions are achieved in relation to assets not controlled under your Will through appropriate elections,
nominations or, if necessary, amendments to constitutional documents.
Upon request we will act as executor of your estate, ensuring that your instructions are carried out as per your Will. We will assume responsibility for areas such as the administration and distribution of assets to beneficiaries, attending to funeral arrangements, collecting any moneys due, paying debts, duties and expenses, preparing tax returns and protecting business interests.
Superannuation
We can give you advice on the adequacy of your current contribution levels and
forecast the amount of superannuation this will provide in retirement. We can provide advice on the most tax effective contribution method for your circumstances, being either salary sacrifice, personal contributions, spouse contributions or a combination of these.
We can provide advice and assist in the establishment of a salary sacrifice
arrangement that meets the requirements of the ATO. Our service extends to the
creation of a bona-fide salary sacrifice agreement. We will also provide an analysis of the potential tax savings that can be made via salary sacrificing.
We can assist or arrange for the rollover of a current superannuation balance to
another fund. We can help you select a fund that fits your investment risk profile and is appropriate to your circumstances.
We will analyse your current and likely future balances to determine whether you
may exceed your RBL limit (the amount of your fund that is concessionally taxed). If you have RBL issues we can assist with a number of strategies to minimise or avoid taxation at excessive rates
We can provide advice on the range of income stream products that are available,
assist you in choosing a product that suits your circumstances and ensure that any Government Benefits are maximised whilst income tax is minimised. We provide advice on the pros’ and con’s of allocated pensions, complying pensions and annuities, short term annuities, transition to retirement pensions and market linked pensions.
Self Managed Superannuation Funds
We will assist you with the establishment of a Self Managed Superannuation Fund
including obtaining an appropriate trust deed and preparing all relevant
documentation.
We will carry out on behalf of the trustees all administration and compliance
requirements for your Self Managed Superannuation Fund to ensure it is properly
maintained in accordance with the applicable Laws.
We do not audit SMSF’s that we administer, but we will arrange for the conduct of
the audit by an appropriate independent firm and facilitate the efficient provision of records and information required.
We will thoroughly review the Deed of your SMSF to ensure compliance with
applicable Laws and consistency with the manner in which the fund is conducted.
We will advise you on the most appropriate and tax effective income streams payable from your SMSF.
We will assist you with the preparation of a binding death nomination to ensure the trustees of your SMSF deal with any residual benefits remaining on death in
accordance with your wishes, ensuring consistency with your overall estate planning intentions.
Trustees of SMSF’s have the responsibility of setting an investment strategy for the
fund and reviewing this on a regular basis. We will assist trustees to develop and
maintain a suitable strategy based on the circumstances of the fund and its members.
We will attend to the preparation of all minutes required to document the decisions and actions of the trustees relating to the activities and conduct of the fund.
